Dear CEO Members
On Monday 30 March 2020, further sections of the Labour Laws Amendment Act came into effect as proclamation 17 was published per Government Gazette 43202, with further implementation of the Labour Laws Amendment Act 10 of 2018.
This amendment is of importance as it amends the Basic Conditions of Employment Act and the Unemployment Insurance Act, in that it:
- provides for parental- (still 10 consecutive days), adoption- (now 10 consecutive weeks), and commissioning parental leave (now 10 consecutive weeks) to employees;
Note: That these forms of leave remain unpaid forms of leave, hence the UIf provisions coupled hereto; unless if the employer pays the employee in full for these forms of leave as a condition of employment/benefit.
- prohibits collective agreements from reducing employees’ entitlement to parental, adoption or commissioning parental leave; and
- amends the Unemployment Insurance Act, providing for the right to claim and payment of parental and commissioning parental benefits from the Unemployment Insurance Fund.
